We have identified that the most effective way of resolving disputes is through mediation.

WHY MEDIATION

DEAD-END DISPUTES

Disputes are an inevitable part of personal and business interaction.  Traditional dispute resolution processes -  through the courts, and positional negotiation strategies - are generally expensive, time-consuming and emotionally burdensome.  These largely inflexible legal processes eventually lead to an unsatisfactory, and  binary, result:  a “winner” and a “loser”.  But after years of litigation burdens, is there even a “winner” in the end? 

 

MEDIATION IS THE OPPORTUNITY

Mediation is an informal alternative dispute resolution process,  where a mediator, or mediators, assist disputing parties to navigate a negotiated workable solution for their dispute. Mediators assist parties to effectively reach settlement by working together.

A competent facilitative mediator does not judge the parties or the matter, but uses skill, proven processes, and insight to guide the parties towards a practical resolution. 

The mediation process is confidential and off the record.

Jodi Neu-Ner (B.Comm LLB)  and Pippa -Leisegang (B.A. LLB) together have 30+ years of litigation and legal commercial experience, and are qualified and accredited as mediators in South Africa and the United Kingdom.   

Jodi served her articles and practised as an attorney at Bowmans in public sector, commercial, forensics, employment, and regulatory law.

Pippa is highly regarded as an insurance litigator in personal injury and medical malpractice. Pippa's experience in negotiation and conflict management  paved the way towards developing a career in mediation.

Any information exchanged during the mediation is both without prejudice and privileged, and is not admissible in any current or future litigation or any other proceedings without the parties express consent.

Should the mediation not succeed, the parties may revert to, or explore, alternate dispute resolution processes, including litigation, without impediment.
